Rule

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Although this has been contested in the past, now it applies to all persons, regardless of the ethnicity and legal status of the parents. "Subject to the jurisdiction thereof" excludes children of foreign diplomats, and children of a nation that is occupying US territory during war. Applies to all American territories except American Samoa and Swains Islands.
